Terms & Conditions

1.

The “Reward” is defined as one (1) brunch reservation for two (2) people, at up to a Fifty ($50.00 USD) value. Gratuity and additional fees are not included.

2.

The Reward is only valid for one (1) brunch reservation for two (2) per customer name/email address, per customer household and per booking group, with the term “booking group” being defined as three or more people accompanying the reservation. Multiple redemptions shall not be redeemed and The Reward Company, Inc., d/b/a TLC Marketing (“Promoter”), shall have no obligation whatsoever to honor any Rewards accepted in violation of these Terms and Conditions. Anyone accompanying the Reward holder is required to pay for any additional people attending the brunch.

3.

Customer must be eighteen (18) years of age or older at the time of purchase to redeem this Reward.

4.

Reward is available only while Reward supplies last.

5.

For the purpose of the Promotion, the term “Released Parties” shall include without limitation, the Promoter, Olympus, and their respective parents, affiliates, partners, subsidiaries, agents and distributors.

6.

Customer is required to purchase one (1) new PEN E-PL8 Camera either in-store or online through the website of an authorized Olympus retailer between 5/1/17 and 8/31/17. (“Final Purchase Date”).

7. The following instructions are required to receive Reward for U.S. Residents:

• After a Qualified Purchase is made the Customer is directed to the promotional microsite to download, complete and postmark the Application Form, found on the Let’s Get Started page, along with the original receipt (purchase confirmation email if purchase was made online) showing the qualifying purchase to the following address within fourteen (14) days of purchase date as indicated on the receipt (“Application”).

• Within fourteen (14) business days after receipt and verification of Application, the qualified Customer will be emailed a unique booking code and a link to the online Booking Form, found on the Booking Form page. Within fourteen (14) days of the date the booking code is sent the Customer must complete and submit the Booking Form in its entirety including the unique booking code, three (3) different brunch locations and three (3) different dates. The Customer will not be able to submit the same brunch location and same date multiple times. When booking the reservation, the set/combination must be different. Fourteen (14) days after the date the booking code is sent the booking code will expire and the Customer will not be able to submit a Booking Form and will not receive Reward.

• Within five (5) business days of Booking Form submission a concierge agent will contact the Customer with brunch availability. Reward cannot be held under the Promotion until reservation is confirmed. Customer must confirm reservation within two (2) business days of the first date of contact by the concierge agent. If reservation is not confirmed within this two (2) business day timeframe the Reward shall automatically become invalid and void. No exceptions will be made.

8. The following instructions are required to receive Reward for Canadian Residents:

• After a Qualified Purchase is made the Customer is directed to the promotional microsite to download, complete and postmark the Application Form, found on the Let’s Get Started page, along with the original receipt (purchase confirmation email if purchase was made online) showing the qualifying purchase to the following address within fourteen (14) days of purchase date as indicated on the receipt (“Application”).

• Within fourteen (14) business days after receipt and verification of Application, the qualified Customer will be emailed a qualified email with a list of brunch locations included. Within fourteen (14) days of receiving that email, the Customer must contact the Olympus Customer Service team to finalize the reservation.

9.

Application void if receipt is photocopied. Application void if Customer does not agree to these Terms and Conditions. Promoter reserves the right to challenge and refuse any incomplete or invalid Applications.

10.  

The contact information submitted on the Application Form must match the information submitted on the Booking Form. The reward is not transferable so the contact information submitted on the Application Form and Booking Form must be for the person who has the reservation for the brunch.

11.  

This Reward is subject to promotional availability and the availability of any Reward is subject to change without notice. All Rewards are available on a first come, first served basis. The Released Parties cannot be held responsible for brunch locations that have sold out or no longer offer brunch. Reward may be subject to restricted availability over peak periods.

12.

Reward is only valid for purchases made in the continental United States (excluding Alaska, Hawaii and U.S. territories) and Canada.

13.  

Promoter reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to Promoter): (i) for the purposes of verifying an individual’s eligibility to participate in this Promotion; (ii) for the purposes of verifying the legitimacy of any purchase transaction or other information; and/or (iii) for any other reason Promoter deems necessary, in its sole and absolute discretion, for the purposes of administering this Reward in accordance with the letter and spirit of these Terms and Conditions. Failure to provide such proof to the complete satisfaction of Promoter within the timeline specified by Promoter may result in disqualification in the sole and absolute discretion of Promoter. All determinations regarding whether or not an individual is eligible to earn a Reward in accordance with these Terms and Conditions will be made by Promoter in its sole and absolute discretion. If it is discovered by Promoter (using any evidence or other information made available to or otherwise discovered by Promoter) that any individual has used or attempted to use multiple names, identities and/or any other means not expressly sanctioned by these Terms and Conditions to participate in or disrupt this Promotion, then he/she may be disqualified from the Promotion in the sole and absolute discretion of Promoter.

14.  

Promoter will use commercially reasonable efforts to book Customer’s preferred dates and preferred brunch locations but cannot be guaranteed by Promoter. Customer may be offered alternative dates which fall before or after the desired dates.

15.  

In addition to these Terms and Conditions, each brunch location may also have their own terms and conditions, which will apply and become binding on Customer upon receipt of the Reward. It is the Customer’s sole responsibility and obligation to comply with these Terms and Conditions as well as the additional terms and conditions of each applicable brunch location provider.

16.

The Reward can be redeemed for two (2) people for brunch. Customer must pay for any additional person attending the brunch. Value of the reward is up to Fifty ($50.00 USD) dollars.

17.

Gratuity and additional fees are not included.

18.

The Released Parties cannot be held responsible for any alterations to any brunch schedules. Released Parties reserve the right to use alternative suppliers if necessary.

19.

Certain brunches may have certain age restrictions. It is Customer’s sole responsibility to check age restrictions for any applicable restrictions for their selected brunch location.

20.  

Reservations are only valid for the brunch location selected at the time of booking. When the Customer has selected the location and the Reward availability has been confirmed by Promoter, the brunch selection is final and cannot be changed or refunded.

21.

No credit, refund or extension for any unused or used Reward will be provided whatsoever.

22.

Additional costs/fees for any products and services outside of the Reward are not included.

23.  

The bearer of the Reward must follow the instructions provided by the Promoter. Failure to comply with any instructions, these Terms and Conditions or any other directives made in conjunction with this Reward may result in cancellation and/or a charge for the Reward. Under these circumstances, Reward shall be considered redeemed and Customer shall be solely responsible for any costs or fees incurred as a result of Customer’s non-compliance.

24. This Reward cannot be used in conjunction with any other promotional offer.

25. Reward void where prohibited or restricted by law.

26. The Released Parties are not responsible for any liability for personal loss or any disagreements concerning availability of Rewards and quality of the brunch. All disputes must be settled directly with the brunch location.

27.  

The Released Parties have no liability for personal loss or injury at any brunch location. Any dispute must be settled directly with the brunch provider concerned.

28.  

The Released Parties shall not be liable for lost, stolen, damaged, misdirected or undeliverable Application Forms, Booking Forms, Reward and/or redemption requests. Due to personal data included on the Application Form, it is strongly recommended that ‘Certified Mail’ through the United States Postal Service is used to ensure that the transfer of the Application Form can be tracked. Mail from 3rd party carriers such as FedEx, DHL and UPS will not be accepted to a P.O. Box. The Released Parties will not issue or replace Application Forms, Booking Forms, Reward and/or redemption requests in any of these events.

29.  

The resale of the Reward is strictly prohibited. Reward is not transferable, transferable for sale, resale, and is not redeemable for cash. The brunch location reserves the right to cancel any reservation that has been resold or transferred.

30.

No refund on the Reward will be made under any circumstances, except at the applicable brunch location’s sole discretion. The Released Parties cannot be held responsible for any refunds.

31.  

This information is correct at the time of Promotion launch, although the Released Parties reserve the right to change details at any time. It is Customer’s obligation to confirm the content of and any restrictions related to the Reward that are contained in these Terms and Conditions as well as the terms and conditions of any brunch location. Brunch locations reserve the right to make the final decision of admission, according to the rules and regulations established at the location. The Released Parties cannot be held responsible for any such decisions.

32.  

Employees or agents of the Released Parties (including each respective affiliates, subsidiaries or vendors specifically involved in this promotion) are not eligible to participate in the Promotion or redeem a Reward. Employees of Released Parties or anyone professionally connected to this promotion are not eligible to participate in the Promotion or redeem a Reward.

33.

The Reward is subject to Reward availability and Promoter reserves the right, in its sole discretion, to substitute a reward of equal or greater value.

34.  

This Reward is issued by the Promoter located at P.O. Box 512, 292 Newbury Street, Boston MA 02115-2832 or at such other address as the Promoter may advise in writing. No inquiry or notice will be validly received by the Promoter unless mailed to the Promoter’s address above by first-class mail, postage prepaid.

35.

The terms of this promotion are as stated here and no other representations (written or oral) shall apply.

36.  

Promoter reserves the right to change or modify the Terms and Conditions of the Promotion at any time during the term thereof. It shall be the bearer’s sole obligation to check the Terms and Conditions during the Promotion and when the bearer redeems the Reward.
